Clickgrub applies a 15% markup on your eCommerce menu prices to cover the costs of essential services. These include eCommerce development, website hosting, SSL certificates, regular updates, 24/7 live chat support, security, integrations, transaction and gateway fees, local SEO, the $100 daily sweepstakes, and purchase intent traffic. All services are bundled to ensure seamless restaurant operations without needing multiple vendors or added expenses.

We Invest in Restaurant eCommerce Traffic

We invest 5% cash back on all eCommerce orders made through your Clickgrub system, up to $1,000 monthly. Clickgrub will use cash back to drive purchase intent traffic to your eCommerce store, whether for dine-in, takeout, delivery, curbside, or catering orders, allowing you to focus on service.:

Additional usage is billed at $0.05 per call minute or SMS, $0.16 per AI segment, and $0.01 per email. Welcome to Clickgrub! Please read these terms and conditions ("Terms") carefully before using our platform and services. By accessing or using Clickgrub, you agree to be bound by these Terms. Please do not use our platform or services if you disagree with these Terms.

1 - Use of Platform

1.1. Eligibility

You must be 18 years old to use our platform and services. By creating an account, you represent that you meet this age requirement. If you are under 18, you may only use the platform with the involvement of a parent or guardian who agrees to these Terms on your behalf.

1.2. Account Ownership

When creating an account on Clickgrub, you must provide accurate and complete information. The person creating the account will be considered the account owner, unless it is created on behalf of a business entity, in which case the business entity will be the account owner. If you register on behalf of a business, you confirm that you have the authority to bind the company to these Terms. The Free Digital Ordering System is free for the lifetime of the digital ordering account. Any one-time fee services will not incur additional costs if an active AI-powered CRM account is available for ongoing maintenance, updates, and support.

1.2.1 Intellectual Property

All websites, domain names, advertising accounts, custom audiences, affiliate programs, social media accounts, AI-powered CRM and training, landing pages, images, targeting, copy, ads, information guides, phone numbers, newsletters, training documents, scripts, reports, and any other materials, systems, offer brand names, technology, or distribution channels, deployed, shared, created, or used during this agreement shall remain the exclusive property of Clickgrub, regardless of any input or contribution from the Client in their development. The inquiries, sales, orders, appointments, reservations, opportunities, and customer database generated as part of our system will always be owned exclusively by the Client.

1.3. Lawful Use

You agree to use Clickgrub only for lawful purposes. You are responsible for ensuring your platform complies with all applicable laws and regulations. You must not use our platform to engage in any prohibited activities, including but not limited to fraud, harassment, or any activity that could harm others.

1.4. Privacy

Your privacy is important to us. Using Clickgrub, you consent to our collection, use, and sharing of your information as described in our Privacy Policy. You also agree to implement and maintain a privacy policy for your customers that protects at least equal to our Privacy Policy. Ensure that your customers are aware of and consent to your privacy practices.

1.5. Security

You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. Notify us immediately if you suspect any unauthorized access to your account. We reserve the right to deactivate your account if we believe it has been compromised.

1.6. Communication Services

Clickgrub may provide communication tools like SMS, email, and voice call capabilities. You are responsible for all communications sent using these tools and must comply with applicable laws, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act. Clickgrub is not responsible for your compliance with these laws.

1.7. Third-Party Services

Our platform may include access to third-party services. Clickgrub is not responsible for the usability or availability of these services. If you pause or delete your account, specific features, such as assigned phone numbers or email addresses, may not be retrievable upon reactivation.

1.8. Content

You retain ownership of the content you post on Clickgrub. However, by posting content, you grant us a non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content. You are responsible for ensuring that your content does not infringe on third-party rights and complies with all applicable laws.

2 - Payment and Subscription

2.1. Fees

Your use of Clickgrub is subject to the payment of fees as outlined in your subscription plan. Fees are billed in advance and are non-refundable, except as described in these Terms. You agree to provide accurate billing information and to keep it updated.

2.2. Taxes

You are responsible for all applicable taxes and governmental fees when using Clickgrub. We may collect taxes on your behalf as required by Law.

2.3. Refunds

Except as required by Law, all fees are non-refundable. If you cancel your subscription, you will have access to the service until your current billing period ends. We reserve the right to issue or deny refunds at our sole discretion.

2.4. Overdue Payments

We may suspend or terminate your access to Clickgrub if we cannot process your payment. You are responsible for any fees or charges incurred due to overdue payments.

3 - Termination

3.1. Termination by You

You may terminate your account at any time by contacting us at [email protected]. Termination will take effect at the end of your current billing period.

3.2. Termination by Us

We may suspend or terminate your account at our discretion, with or without notice, if we believe you have violated these Terms or engaged in fraudulent or illegal activities.

3.3. Effect of Termination

Your right to use Clickgrub will immediately cease upon termination. However, any provisions of these Terms that should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

4 - Disclaimers and Limitations of Liability

4.1. Disclaimer of Warranties

Clickgrub is provided "as is" and "as available" without any warranties, either express or implied. We do not warrant that the platform will be uninterrupted or error-free.

4.2. Limitation of Liability

To the fullest extent permitted by Law, Clickgrub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

1. Your use or inability to use the platform.

2. Any unauthorized access to or use of our servers and personal information stored therein.

3. Any interruption or cessation of transmission to or from the platform.

4. General Provisions.

5.1. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting them on our website. Your continued use of Clickgrub after such changes constitutes your acceptance of the new Terms.

5.2. Governing Law

These Terms are governed by the laws of the State of Florida without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the courts of Florida.
